Good things come in small packages. So don't be fooled by our size, we do big things for big brands. We are a group of designers based in Auckland and we believe that presentation is everything. Our success story can be credited to many things, but we like to think it's because of our friendly approach and polished design. We get a buzz out of creating a concept that works for you. If you're happy, we're happy. We offer reasonable prices and we pat ourselves on the back for sticking to our deadlines. And yeah...we do love going to the movies on cheap Tuesdays, but building brands is our obsession.

With a few years of experience under my belt, working with companies like Air NZ, Vodafone and Les Mills. I play an important part in the design process of all our creative projects. I love design with a polished finish.

(By using the services of Varnish Studios you agree to following terms and conditions.)

1 Design and Development

Supplied Content Clients will obtain all the necessary permissions and authorities in respect of the use of all copy, graphic images, photography, company logos, names and trademarks or any other material it supplies to Varnish Studios for inclusion on the website or in other branding material.

Client Review Varnish Studios will provide the Client with an opportunity to review the design materials during all design and development process. Once they have approved the design. The Client will need to notify Varnish Studios in writing within seven (7) days. Any design changes requested after written approval will be charged at NZ$75.00/hr.

Print Work Varnish Studios must receive written sign off or email from the client for all artwork before it is sent to print. Although Varnish Studios can match the business colours, the Client will have to allow for a minimal colour difference in print work.

Browser Support Websites will be built to work in the following browsers: Internet Explorer 7, 8 and 9; Firefox 3; Google Chrome and Safari. Support for additional older browsers or mobile browsers must be agreed before work commences and possible costs may apply.

Search Engine Ranking Varnish Studios does not guarantee set ranking on Search Engines and the Client accepts that it is Search Engines, and not Varnish Studios, who determine whom they list and whom they will not. The Client further understands there is no guaranteed placement or rank on the Search Engines. Varnish Studios does not control Search Engines algorithms and huge shifts can appear daily, weekly and even hourly.

2 Length of the proposal

Quotes and proposals made by Varnish Studios should be treated as confidential information and remain the property of Varnish Studios. Such offers and proposals or the information contained within them must not be passed to third parties. All proposals are valid for 30 days from the date of issue.

3 Fees and other charges

Payment All design and development services require an advance payment of 20% of the total before any work commences. The remainder of the invoice will be due upon compl- etion of the work or an agreed schedule of payments. Payment for services is due by cash, Cheque or Direct Credit. Invoices will be emailed by Varnish Studios upon completion of the work for the design services. Invoices are due for payment within seven days of the date of sending, unless otherwise agreed.

Remedies for Overdue Payment Accounts unpaid fourteen (14) days after the date of invoice will be considered late and any information or files will be removed at Varnish Studios discretion. The Client will from then on be liable for all subsequent costs incurred in recovering the debt. These costs include, but are not limited to, full solicitor costs, debt collection, court costs. Invoices that remain unpaid after the due date will incur a penalty fee of 2% per month. Removal of design material does not relieve the Client of the obligation to pay any outstanding charges. Once payment has been received, the client will be charged a fee for uploading web files back onto the server. This fee will be billed at NZ$100.00/hr.

4 Changes and “after–contract” additions

All quotes and design shall be based on a written brief supplied by the client and agreed to by Varnish Studios. It is important to place a brief in writing to clearly point out particular design requirements. Varnish Studios will not be responsible for any errors to misunderstanding a verbal brief. Varnish Studios will accept reasonable changes during the design and development process and Varnish Studios will be the sole judge of what is deemed to be 'reasonable'. Changes that Varnish Studios consider unrea- sonable may incur an additional charge of $75/hr. With the exception of print work that has been sent to the printer, print work that has been approved and printed will charge be at the Client expense.

5 Client / Designer Responsibilities

If the client provides you materials to work from and they’re lost or damaged it must be accounted and compensated for. The personal information supplied to Varnish Studios will be stored by Varnish Studios on a secure backup system. Varnish Studios will not share your personal information with any other third party. Whilst all care is taken to offer a secure system we cannot provide a 100% guaranteed secure backup system. Please note, the information you provide is provided at your own risk. The projects carried out by Varnish Studios will be at the highest of design standards and Varnish Studios will work hard with the client to achieve the best possible outcome for the project.

6 Design Credit

A link to Varnish Studios will appear discretely in small type at the bottom of the Web site’s pages of the Customer's Web site unless otherwise agreed.

7 Termination policy

Varnish Studios reserves the right to refuse or break a contract without prior notice, if it is believed that the client, their website, or any branding material is illegal, immoral or otherwise deems to be unacceptable. Once the design and development has been commenced the deposit will be non-refundable if the client was to terminate the contract.

8 Applicable law

The Consumer Guarantees Act 1993 may apply to any services we provide to you if you acquire these services for personal, domestic or household use. If this act applies, all rights you may have under it apply in addition to the rights you may have in this agreement. Nothing in this agreement will limit or exclude your rights under this act. Where you acquire or hold yourself out as acquiring our services for the purpose of a business, then you agree that the provisions of the Consumers Guarantee Act 1993 will not apply to our service or the provision of any other services to you. This agreement shall be deemed to be an agreement made in New Zealand and shall be subject to, governed by and interpreted in accordance with the laws of New Zealand.
